Summary
In Criminal Appeal No. 281 of 2025, Anandrao Sarjerao Thombare (appellant) challenged the jurisdiction of the High Court proceedings, seeking transfer to a Sessions Court. The appellant, through counsel, relied on the Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) which held that similar matters should be tried before the Sessions Court having jurisdiction. The respondent State, represented by Dr. A. A. Takalkar, opposed the transfer. Justice Ashwin D. Bobe ordered that the proceedings be transferred to the appropriate Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register, issue notices, and expedite the case. The appeal and any interim applications were thereafter disposed of.
