The High Court ordered that the proceedings be transferred to the Sessions Court having jurisdiction.

Summary

The appellant, Vasantdada Shetkari Sahakari Bank Ltd., filed a criminal appeal (No. 283 of 2015) against Dhairyashil Udaysinh Deshmukh and others. The parties argued, relying on the Supreme Court decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320), that the proceedings should be before a Sessions Court having jurisdiction. The High Court examined the jurisdictional issue and agreed to transfer the case to the appropriate Sessions Court. It directed the Registrar to effect the transfer, ordered the Sessions Court to re‑register the case, issue notices, and expedite the matter. Consequently, the appeal and any interim applications were disposed of.
