The Court ordered that the proceedings be transferred to the Sessions Court having jurisdiction.
Summary
Paygonda Bapu Patil appealed against Sachin Vilasrao Mane and another, seeking relief in the Bombay High Court. The appellant and the State counsel relied on the Supreme Court’s decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the case should be heard by a Sessions Court with appropriate jurisdiction. The Court agreed that the proceedings were more suitably dealt with by the Sessions Court and ordered their transfer. It directed the Registrar to effect the transfer, instructed the Sessions Court to re‑register the case, issue notices, and expedite the matter. The appeal and any interim applications were thereafter disposed of.
