The High Court held that the criminal proceedings must be transferred to the Sessions Court having jurisdiction.
Summary
The High Court of Bombay, Kolhapur Circuit Bench, heard Criminal Appeal No. 313 of 2018 filed by Ramchandra Bapu Sangar against Pramodkumar Vasantrao Patil and another. The appellant argued that the proceedings should be transferred to a Sessions Court having jurisdiction, relying on the Supreme Court’s decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320). The Court examined the jurisdictional question and the need for efficient case management. It ordered that the matter be transferred to the appropriate Sessions Court, re‑registered, and that the Sessions Court issue notice and expedite the proceedings. Consequently, the appeal and any interim applications were disposed.
