Decided
Disposal
Disposed off as Withdrawn

Holding

The appeal may be withdrawn and the appellant shall be deemed to be in custody for the purpose of deciding the regular bail application, leading to the disposal of the appeal.

Summary

Santosh Tukaram Rathod appealed against the State of Maharashtra. While the appeal was pending, the prosecution filed a charge‑sheet. The appellant, through counsel, sought permission to withdraw the appeal and to file a regular bail application before the Special Court/Trial Court. The Court allowed the withdrawal, directing that the appellant be deemed to be in custody for the purpose of the bail application, which the Special Court must decide on its merits. Consequently, the appeal was disposed of on these terms.

Issues considered
