Holding

The appeal was disposed, permitting withdrawal and granting liberty to apply for regular bail, with the appellant deemed to be in custody.

Summary

The appellant, Pravin Bhagwanrao Jadhav, appealed against the State of Maharashtra. While the appeal was pending, the prosecution filed a charge‑sheet. The appellant’s counsel sought permission to withdraw the appeal and to file a regular bail application before the Special Court/Trial Court. The High Court allowed the withdrawal, directing that if a bail application is filed within three weeks, the appellant shall not be arrested until the bail application is decided and shall be treated as deemed to be in custody. The Special Court/Trial Court was directed to decide the bail application on its merits. Consequently, the appeal was disposed of on these terms.
