Summary
The appellant, Yashwant Sahkari Glucose Karkhana Ltd, filed a criminal appeal (No. 339 of 2015) before the Bombay High Court, Circuit Bench, Kolhapur. Neither the appellant nor its counsel appeared before the court. The respondent‑State, through counsel S.S. Choudhari, relied on the Supreme Court’s decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be heard by the Sessions Court having territorial jurisdiction. The High Court agreed, directing that the proceedings be transferred to the appropriate Sessions Court for re‑registration and further hearing. The court also instructed the Sessions Court to expedite the case and ordered the Registrar to effect the transfer. Consequently, the criminal appeal and any interim applications were disposed of.
