Bombay High Court
SHAFIK QUADRI S/O MD RAFIK QUADRIversusSTATE OF MAHARASHTRA
- Disposal
- DISPOSED OFF
Holding
The High Court held that the prosecution failed to prove the offences under Sections 302, 201 and 34 IPC, and therefore set aside the convictions and acquitted the accused.
Summary
The accused, Mohammad Shafik and Khamrunnisa Begum, appealed convictions recorded by the Sessions Judge in Sessions Case No. 77 of 2018 for offences under Sections 302, 201 and 34 of the Indian Penal Code. The High Court of Bombay, Aurangabad Bench, examined the evidence and found that the prosecution had not established the elements of murder, concealment of a dead body, or common intention beyond reasonable doubt. Consequently, the Court set aside the convictions and acquitted both accused of the charges. The bail bonds of the accused were cancelled, and they were ordered to be released unless required in any other case. The appeals and any pending applications were disposed of.
Issues considered
- Whether the conviction under Sections 302, 201 read with Section 34 IPC is sustainable on the evidence presented
- Whether the prosecution proved the elements of murder, concealment of a dead body, and common intention beyond reasonable doubt
- Whether the bail bonds of the accused should be cancelled following acquittal
