The appeals are to be transferred to the concerned District and Sessions Court as they fall within the scope of the proviso to Section 372 CrPC as interpreted by the Supreme Court.
Summary
The appellants, Anil Babulal Katariya, filed multiple criminal appeals (Nos. 464, 465, 466, 467 of 2009 and others) against the trial court's acquittal under Section 138 of the Negotiable Instruments Act. They sought to have the appeals transferred to the District and Sessions Court, relying on the Supreme Court’s decision in Celestium Financial v. Ganasekaran (2025) which interpreted the proviso to Section 372 of the Code of Criminal Procedure. The learned Judge examined whether the transfer order was permissible under the statutory framework and the Supreme Court precedent. The Court concluded that the appeals could indeed be transferred to the concerned District and Sessions Court for further adjudication. Accordingly, an order was issued directing the Registrar to effect the transfer and directing the Sessions Court to treat the matters as appeals under Section 372( proviso).
Issues considered
- Whether appeals against acquittal under Section 138 of the Negotiable Instruments Act can be transferred to a District and Sessions Court under the proviso to Section 372 of the Code of Criminal Procedure in light of the Supreme Court’s decision in Celestium Financial v. Ganasekaran.

PER COURT :-
1. Learned counsel for the appellants points out that, the instant
appeals have been preferred against the judgment and order of

Hon'ble Supreme Court in Celestium Financial v. Ganasekaran Etc.,
[(2025) SCC OnLine SC 1320], he would contest the appeals before
learned District and Sessions Court and hence urges that the same be
transferred to the District Court.
2. In view of the above, the following order is passed :
{3} CR APPEAL 464 OF 2009+
ORDER
I. The present proceedings be transferred to the concerned
District and Sessions Court.
II. Learned Registrar (Judicial) of this Court to take further
necessary action for transferring these matters to the concerned

III. The learned Sessions Court to whom these matters will be
assigned, after registering it, shall issue notice to the concerned
parties, and thereafter, proceed further with the matters in
accordance with law.
IV. The concerned Sessions Court shall treat these matters as
appeals under proviso to Section 372 of the Code of Criminal
Procedure as per the observations of the Hon'ble Supreme Court in
