Holding
The appeal is transferred to the Sessions Court having jurisdiction, and the High Court disposes of the appeal.
Summary
The appellant, Aakanksha Ashok Nagvekar, was absent from the hearing of Criminal Appeal No. 526 of 2016 before the Bombay High Court, Kolhapur Bench. The State's counsel, S. H. Yadav, relied on a recent Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be heard by a Sessions Court having jurisdiction. The Court agreed and ordered the transfer of the appeal to the appropriate Sessions Court, directing the registrar to effect the transfer and re‑registration. The Sessions Court was instructed to issue notices, expedite the case, and dispose of it on its merits. Consequently, the High Court disposed of the appeal and any interim applications.
Issues considered
- Whether the High Court has jurisdiction to continue the criminal appeal or it must be transferred to a Sessions Court having jurisdiction.
