The appeal is dismissed and the proceedings are ordered to be transferred to the Sessions Court having jurisdiction.

Summary

In Criminal Appeal No. 533 of 2015, the appellant Basaveshwar Balasaheb Koshti and his counsel were absent from the hearing. The State, represented by Advocate Nitin B. Patil, relied on the Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be tried before a Sessions Court having jurisdiction. The High Court agreed that the proceedings were improperly before it and ordered their transfer to the appropriate Sessions Court. The order directed the Registrar to effect the transfer, the Sessions Court to re‑register the case, issue notices, and expedite the trial. Consequently, the appeal and any interim applications were disposed of.
