RANGRAO DADU PATILversusBAJIRAO MARUTI KUMBHAR (MHARULKAR) AND ANR

Disposal

Holding

The High Court ordered that the pending criminal proceedings be transferred to the Sessions Court having jurisdiction, as mandated by the Supreme Court precedent.

Summary

The appellant, Rangrao Dadu Patil, filed a criminal appeal before the Bombay High Court against respondents Bajirao Maruti Kumbhar and others. Both parties argued that, following the Supreme Court’s decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320), the matter should be heard by the Sessions Court having territorial jurisdiction. The learned counsel for the appellant and the State relied on that precedent to seek transfer of the proceedings. The High Court, after considering the submissions, ordered that the proceedings be transferred to the appropriate Sessions Court, directing the registrar to effect the transfer and the Sessions Court to re‑register and expedite the case. Consequently, the appeal and any interim applications were disposed of.
