Holding
The High Court held that the criminal proceedings must be transferred to the Sessions Court having jurisdiction, as per the Supreme Court precedent.
Summary
Siddhappa Rayyappa Mudegoal appealed to the Bombay High Court against Rammanna Satayappa Pradhane and another, seeking relief in criminal appeals No. 756 and 757 of 2015. The appellant argued that the matters should be tried by the Sessions Court having territorial jurisdiction, relying on the Supreme Court’s decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320). The High Court examined the precedent and concluded that the jurisdiction indeed lay with the Sessions Court. Consequently, the Court ordered the transfer of the proceedings to the appropriate Sessions Court and directed expeditious handling. Both criminal appeals and any interim applications were disposed of following the transfer order.
