Summary
The appellant, Katar Garments and Textiles, was absent from the hearing of Criminal Appeal No. 913 of 2012. The respondent State, through Advocate A. A. Takalkar, cited the Supreme Court decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320) to argue that the matter should be before a Sessions Court with appropriate jurisdiction. The High Court agreed that the appeal should be transferred to the competent Sessions Court. The court directed the Registrar to effect the transfer, re‑registration, and issuance of notice by the Sessions Court. It also instructed the Sessions Court to expedite the proceedings, and the appeal was formally disposed of.
