Holding

The High Court held that the proceedings must be transferred to the Sessions Court having jurisdiction.

Summary

The appellant, Suresh Dhondiram Bhongale, filed a criminal appeal before the Bombay High Court against respondents Ranjana Vijay Gaikwad and another. The appellant's counsel, citing the Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320), argued that the matter should be heard by the Sessions Court having territorial jurisdiction. The High Court examined the jurisdictional issue and agreed that the proceedings were more appropriately before the Sessions Court. Consequently, the Court ordered the transfer of the entire case to the competent Sessions Court, directing the Registrar to effect the transfer and the Sessions Court to re‑register, issue notices, and expedite the matter. The appeal and any interim applications were thereafter disposed.
