The court may correct an inadvertent error in its order by speaking to minutes and issuing a fresh order.
Summary
In Criminal Appeal No. 938 of 2025, the appellant Jayesh Sanjay Fatehlashkar sought correction of a previous order dated 20.08.2026, alleging that the court's disinclination to grant relief was not reflected in the order. The appellant's counsel argued that the omission was an inadvertent error. The court examined whether such an error could be rectified by speaking to minutes. Finding the error to be inadvertent, the court allowed the prayer for speaking to minutes. It directed that the necessary corrections be made and a fresh order be uploaded.
