Summary
The High Court of Bombay, Kolhapur Circuit Bench, heard Criminal Appeals Nos. 939 and 941 of 2013 filed by Vasant Corporation Sangli against Raju Traders Sangli & Anr. The appellant and its counsel were absent, while the respondents' counsel cited the Supreme Court decision in Celestium Financial Ltd. v. A. Gnanasekaran (2025 SCC OnLine SC 1320) indicating that such matters fall within the jurisdiction of the Sessions Court. The Court agreed that the appeals should be transferred to the appropriate Sessions Court. It ordered the Registrar to effect the transfer, directed the Sessions Court to re‑register the cases, issue notices, and expedite the proceedings. Consequently, both criminal appeals and any interim applications were disposed of by transfer.
