The High Court ordered the transfer of the criminal appeal to the Sessions Court having jurisdiction.
Summary
The appellant, Shree Datta Sahakari Sakhar Karkhana Ltd., filed a criminal appeal (No. 956 of 2009) before the Bombay High Court, Circuit Bench at Kolhapur. The appellant and the State counsel, relying on the Supreme Court decision in Celestium Financial v. A. Gnanasekaran (2025 SCC OnLine SC 1320), argued that the matter should be heard by the Sessions Court having territorial jurisdiction. The High Court considered the submission and ordered that the proceedings be transferred to the appropriate Sessions Court, directing the Registrar to effect the transfer and the Sessions Court to re‑register the case, issue notices, and expedite the matter. The court also directed the parties to cooperate for early disposal. Consequently, the criminal appeal was disposed of, and any interim applications were also dismissed.
