The court granted the applicant liberty to file a fresh application challenging the impugned order if the charge‑sheet is not filed within four weeks.
Summary
The applicant, Irfan Mohammed Shaukat Niyamat Khan, filed a criminal application under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging a February 4, 2026 order of the Judicial Magistrate that denied him permission to travel abroad. Earlier, the applicant’s prior application was withdrawn on the condition that a charge‑sheet be filed within four weeks, but more than three months elapsed without filing. The State argued that the investigating officer’s transfer caused the delay, and now the investigation is ongoing with a new officer. The applicant sought to withdraw the fresh application and retain the liberty to file another if the charge‑sheet is not filed within four weeks. The court granted liberty to file a fresh application if the charge‑sheet is not filed within the stipulated period, otherwise the applicant must approach the trial court, and any subsequent application will be decided on its merits.
Issues considered
- Whether the order of the Judicial Magistrate denying permission to travel abroad is valid under section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
- Whether the applicant is entitled to liberty to file a fresh application if the charge‑sheet is not filed within four weeks.
