The order dated 09.06.2026 passed by the Judicial Magistrate, First Class, Borivali is quashed and set aside.

Summary

The applicants, Atul Amritlal Rana and another, filed a criminal application seeking to quash an order dated 09.06.2026 passed by a Judicial Magistrate in Borivali, which had directed that a complaint and investigation continue despite a police "C" Summary Report indicating no prima facie breach of trust. The magistrate’s order was based solely on the fact that the complainant was a government servant, without assigning any substantive reason. The High Court examined the summary report and found no basis to intervene in the police’s finding. Consequently, the Court quashed and set aside the magistrate’s order and accepted the police summary report, ordering the discharge of the applicants. The application was allowed and disposed of.

Issues considered

  • Whether the magistrate’s order directing continuation of the complaint and investigation, despite a police summary report finding no prima facie case, can be set aside.
  • Whether Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, empowers the High Court to quash such an order.
