Bombay High Court

RADHA SUNIL CHANDOLEversusSTATE OF MAHARASHTRA

Disposal
Disposed Off

Holding

The application is disposed of as infructuous because the investigating officer’s “C” Summary Report shows no evidence to proceed.

Summary

The applicant, Radha Sunil Chandole, filed a criminal application before the Bombay High Court, Kolhapur Bench, seeking relief in a case where the investigating officer had submitted a “C” Summary Report on 11 January 2025 indicating that no evidence was found against her. The applicant's counsel, relying on this report, moved that there was nothing further for the Court to consider and requested disposal of the application. The Court accepted the counsel's statement and disposed of the application as infructuous. The judgment also noted that if the trial court were to reject the “C” Summary Report, the applicant could file a fresh application. No substantive merits of the original charges were addressed, as the matter was deemed concluded by the summary report.
