The appellate court quashed the orders denying cross‑examination and granting adjournments, directing immediate cross‑examination and no further adjournments to comply with the Supreme Court’s timeline.

Summary

Dagadu @ Subhash Ashok Khandbhor (UTP) filed an application challenging two orders of the Additional Sessions Judge, Vadgaon Maval, which denied his request to cross‑examine the investigating officer and an eyewitness, and granted adjournments. The Supreme Court had earlier directed that the trial in S.C. No. 478 of 2022 be concluded within six months and allowed a fresh bail application if the trial was not completed. The applicant argued that his counsel’s illness on 10 August 2026 prevented the cross‑examination, prompting applications (Exhibit‑217 and Exhibit‑210) for time. The appellate court held that the lower court’s orders impeded the Supreme Court’s directive and were therefore untenable. It quashed both orders, directed that the witness and investigating officer be produced for cross‑examination on the same day, and barred any further adjournments. The court also instructed the Sessions Court to ensure the trial’s completion within the Supreme Court‑prescribed timeline.

Issues considered

  • Whether the Additional Sessions Judge’s orders denying cross‑examination and granting adjournments can be set aside in view of the Supreme Court’s directive to expedite the trial.
  • Whether the applicant’s right to cross‑examine the investigating officer and eyewitness can be curtailed due to procedural delays.
