The Court held that the application is allowed and the Divisional Commissioner must expedite the hearing of the appeal and dispose of it within eight weeks.

Summary

The applicant, Shravan @ Aavan Janardan Chavan, filed a criminal application seeking a direction to the Divisional Commissioner, Konkan Division, Mumbai, to expedite the hearing of his appeal against an Externment Order dated 7 January 2026, which barred him from Greater Mumbai for 18 months. The applicant argued that the order caused severe hardship to him and his dependent mother and that there was insufficient material to justify the externment. The respondent State of Maharashtra opposed the application. After hearing both sides, the Court allowed the application, directing the Divisional Commissioner to hear the appeal and dispose of it within eight weeks of the order’s communication. The application was consequently disposed of on those terms.

Issues considered

  • Whether the Externment Order was passed without sufficient material and caused undue hardship to the applicant.
