Holding

Where the parties have amicably settled the dispute and the respondent withdraws all allegations, the FIR, charge‑sheet and pending criminal case may be quashed.

Summary

The applicants filed a criminal application seeking quashment of FIR No. 361 of 2025, the accompanying charge‑sheet and the pending criminal case, alleging that the dispute with Respondent No.2 had been settled. The parties produced a consent term and a report of the Judicial Registrar confirming the settlement and the withdrawal of all allegations by Respondent No.2, except that Applicant No.4 had not signed the settlement. The Respondent’s counsel admitted the settlement and the withdrawal of claims. The Court examined the settlement documents and found no remaining controversy, concluding that the criminal proceedings were no longer required. Accordingly, the Court allowed the application and quashed the FIR, charge‑sheet and the criminal case, disposing of the application without costs.

            PER COURT :-

            1. Heard the learned Advocate for the applicants.

            2. The present application is filed for quashing of the First

learned Chief Judicial Magistrate, Dhule alongwith the order of taking

            cognizance dated 25.12.2025.

            3. The learned Advocate for the applicants submits that the

parties have settled the dispute among themselves and they have no

allegations against each others. The copy of the consent terms has also

been produced on record, which is duly filed under the signatures of all

the applicants and Respondent No.2. The parties have appeared before

                                                                                1 of 3
                                                             965appln1480-26

the learned Registrar(Judicial) of this Court who has verified the

contents of the settlement terms and has also verified their identity. The

learned Registrar(Judicial) has filed a report of compromise dated

11.08.2026, which specifically states that the applicants and

Respondent No.2 have filed settlement pursis. The learned Registrar

(Judicial) has read over and explained the contents of the settlement

pursis to them. They admitted and accepted the contents therein as

true and correct. They admit their respective signatures and thumb

impressions. Therefore, in the report, it is submitted that the parties

withdrawing the allegations against each other.

5. I have perused the report of the learned Registrar (Judicial) as

well as the consent terms that has been produced before this Court.

withdrawing all the allegations against the applicants and also

                                                                   965appln1480-26

consents for quashment of the FIR No. 361 of 2025 dated 20.10.2025

lodged by Respondent No.2 with West Deopur Police Station, District

Dhule and the parties have undertaken that they will not file any

further proceedings against each other. Taking into consideration the

report of the learned Registrar (Judicial), the consent terms filed on

record by the parties, and the fact that the entire dispute between the

parties has been resolved, there is nothing remained to be adjudicated

           in the present application.

           6. In the light of the above, the present application stands

allowed in terms of prayer clause (A).
