PRATHMESH PROMOD UPGANLWARversusSAJID MAJID KHAN AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court granted anticipatory bail to Applicant No. 2, finding no material evidence of his involvement in the alleged offences.

Summary

The High Court heard an anticipatory bail application filed by Sajid Majid Khan and Moin Majid Khan in connection with FIR No. 36/2026 alleging fraudulent crop‑insurance claims. Applicant No. 1 withdrew his application, leading to its dismissal. Applicant No. 2 contended that there was no evidence of his involvement, no criminal history, and offered to submit his mobile to investigators. The State opposed bail, arguing that Applicant No. 2 assisted his brother in photographing fields for the alleged fraud. The Court found no prima facie material linking Applicant No. 2 to the offences punishable under the Bharatiya Nyaya Sanhita, 2023. Consequently, the Court granted anticipatory bail to Applicant No. 2 subject to a cash bond, surety, and several conditions including non‑contact with witnesses. The order also directed his cooperation with the investigating agency and attendance at the police station as required.

Issues considered

  • Whether anticipatory bail should be granted to Applicant No. 2 in view of the allegations under the Bharatiya Nyaya Sanhita, 2023.
  • Whether there is sufficient evidence to justify denial of bail for Applicant No. 2.
