The court allowed the transfer of the domestic violence proceedings to the Family Court to prevent conflicting judgments.
Summary
The husband filed an application under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking transfer of the wife’s domestic violence case under the Protection of Women from Domestic Violence Act, 2005, to the Family Court where his divorce petition is pending. He argued that both matters involve allegations of cruelty and should be decided by a single court to avoid conflicting findings. The wife contended that the two proceedings are distinct and the transfer should not be entertained. The court considered the risk of inconsistent decisions and found merit in the applicant’s concern. Consequently, the court allowed the application and ordered the transfer of the domestic violence proceedings to the Family Court. The application was disposed of after the order.
