Holding
A criminal appeal does not abate on the death of the appellant; the legal heirs may continue the appeal as his representatives.
Summary
The original complainant, Pratapsingh, appealed a trial court judgment that acquitted Vasantrao Mulavekar of an offence under Section 500 IPC. Pratapsingh died before the appeal was decided. His heirs filed a criminal application seeking to be recognized as his legal representatives and to continue the appeal, while the accused filed a separate application arguing that the appeal should be abated due to the complainant's death. The High Court, relying on Supreme Court precedents (Ashwin Nanubhai Vyas and Balasaheb K. Thackeray cases), held that an appeal does not automatically abate on the death of the appellant and that heirs may step into his shoes. The court dismissed the accused’s application, condoned the six‑month delay in the heirs’ filing, and allowed the heirs to be placed on record to prosecute the appeal, ordering necessary amendment within four weeks.
Issues considered
- Does the death of the original complainant (appellant) automatically abate a pending criminal appeal?
- Are the legal heirs entitled to continue the appeal in place of the deceased appellant?
- Whether the six‑month delay in filing the heirs' application can be condoned?
