Bombay High Court

KISHOR S/O. AWACHITRAO DESHMUKHversusBHAUSAHEB S/O. SARJERAO KALE (PATIL) AND ANR

Disposal
DISPOSED OFF

Holding

The Court held that, given the existence of an alternate remedy, it will not direct registration of the offence and dismissed the petition.

Summary

Bhausaheb Sarjerao Kale (Patil) filed a criminal writ petition seeking a court direction to register an offence against the then Tahsildar, Kishor Deshmukh, for alleged misappropriation of government funds. A departmental enquiry had already been conducted, resulting in the Tahsildar's salary increment being stopped for one year. The petitioner requested that the court order registration of a FIR under Section 156(3) of the Code of Criminal Procedure, 1973. The learned Additional Public Prosecutor submitted that the departmental enquiry was the appropriate remedy. The Court held that because an alternate remedy existed, it would not direct registration of the offence and dismissed the petition.

Issues considered

  • Whether the High Court can direct registration of an offence under Section 156(3) of the CrPC when a departmental enquiry has already been conducted and an alternative remedy is available.
