Bombay High Court

PARAJI AABAJI LOKHANDE AND OTHERSversusTHE STATE OF MAHARASHTRA

Disposal
APPLICATION ALLOWED

Holding

The Court held that the delay of 183 days is condoned and the criminal revision is allowed.

Summary

The petitioners, Paraji Aabaji Lokhande and others, filed a criminal revision (ST) No. 8172 of 2026 challenging an order, but did so after a delay of 183 days. They sought condonation of this delay, arguing sufficient cause. The State, represented by M. A. Aher, opposed the condonation. The Court examined the application and found the reasons for delay satisfactory and sufficient cause shown. Consequently, the Court allowed the petitioner's prayer to condone the delay, registered the revision, and issued notice to the State, which waived service of notice. The order thus permits the revision to proceed despite the procedural lapse.
