Disposal
APPLICATION ALLOWED

Holding

The court allowed the restoration of the original criminal proceedings.

Summary

The petitioners filed criminal applications seeking restoration of original criminal proceedings that had been dismissed because they failed to comply with a court order to amend the pleadings within the stipulated time. The petitioners assured the court that the required amendment would be completed within two weeks. Both sides indicated that the dispute had been amicably settled and that the original proceedings could be reconsidered in light of this settlement. The court accepted the assurance, allowed the applications for restoration, and ordered that the original proceedings be listed for hearing on 15 October 2026.

Issues considered

  • Whether the original criminal proceedings dismissed for non‑compliance with an amendment order can be restored.
  • Whether an amicable settlement between the parties justifies restoration of the dismissed proceedings.
