PRAJAKTA SURESH DHASversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is dismissed and the related criminal application is disposed.

Summary

The petitioners, Bhange Organic Chemicals Private Limited, challenged a letter dated 22 June 2023 that denied their request for police protection while working in their company. They had earlier applied for such protection on 6 May 2023, but the impugned letter gave no reasons for the refusal. The intervenor counsel informed the court that the petitioner's company is now closed and arbitration proceedings are pending. The court observed that the petitioners had not pursued the matter diligently and were absent from proceedings. Consequently, the court disposed of the criminal writ petition and the related criminal application No.4091 of 2023.

Issues considered

  • Whether the denial of police protection as per the letter dated 22 June 2023 can be challenged in a criminal writ petition
  • Whether the petition remains maintainable given the closure of the petitioner's company and lack of diligence

Subjects

  • police protection
  • criminal writ petition
  • petition dismissed

1] None for the petitioners. Though the petitioners

have challenged letter dated 22.06.2023 for not providing him

police protection, but it appears that under the application

protection while doing the work in their company. Admittedly,

the impugned letter has not given any reasons as to why

police protection was rejected, but the learned counsel for

intervenor, on instructions, submits that the Company of the
