DISPOSED OFF

Holding

The court condoned the 150‑day delay and disposed of the criminal revision application.

Summary

The applicants filed a criminal application seeking condonation of a 150‑day delay in filing a criminal revision. The revision was intended to pre‑empt execution of an impugned order against the respondent wife, but the record showed no execution steps had been taken. The applicant argued that his grievance was presently redressed but might arise again if execution were initiated. The court, after considering the reasons, condoned the delay and disposed of the revision application, granting the liberty sought. The matter was thus closed pending any future execution proceedings.

Issues considered

  • Whether a delay of 150 days in filing a criminal revision can be condoned under procedural law
  • Whether the revision application should be dismissed or disposed of on the basis that the impugned order has not been executed
