Bombay High Court

National Highways Authority Of India Through Its Project DirectorversusRajashree Anil Tandale And Others

Disposal
DISMISSED

Holding

The arbitration appeal is dismissed as it is covered by the earlier order dismissing related appeals.

Summary

The National Highways Authority of India (NHAI) appealed an arbitration proceeding involving three landowners and the Competent Authority for Land Acquisition. The appellant argued that the matter was already decided in Arbitration Appeal No. 72 of 2025, which had been dismissed. The court held that the present appeal was subsumed by the earlier order and therefore dismissed it, also disposing of the pending application. The court upheld a prior district court judgment dated 15 July 2025. It directed the parties to appear before the arbitrator on 28 September 2026, with the arbitrator to render a decision by 31 March 2027, and ordered the appellant to pay the deficit court fees by 30 September 2026.
