Holding

The arbitration appeal is dismissed, and the pending application is disposed of, with the earlier order affirmed.

Summary

The National Highways Authority of India (NHAI) appealed an arbitral award concerning a land acquisition dispute with Sanjay Rajendra Late and the Competent Authority. The appellant argued that the matter had already been decided in Arbitration Appeal No. 72 of 2025, which was dismissed by this Court. The Court affirmed that earlier order and consequently dismissed the present arbitration appeal, also disposing of the pending application. It upheld the judgment dated 15 July 2025 of the Principal District Judge, Beed, and directed the parties to appear before the arbitrator on 28 September 2026. The arbitrator was instructed to render a decision before 31 March 2027, and the appellant was ordered to pay the deficit court fees by 30 September 2026.
