Holding

The Court held that with the full payment made, there was nothing left for consideration and the appeals were disposed of as withdrawn.

Summary

Wallace Pharmaceuticals Pvt. Ltd. filed three appeals under the Employees' State Insurance (ESI) scheme challenging the liability for payments in cases AUE/01/2024, AUE/02/2024 and AUE/1553/2022(F). The Deputy Director of the Employees' State Insurance Corporation informed the Court that the entire sum of Rs.94,97,295 had been received in full under the New Amnesty Scheme 2025. On learning that the disputed amount was already paid, the appellant sought permission to withdraw the appeals. The Court observed that no issue remained for adjudication once the full payment was effected. Accordingly, the Court allowed the withdrawal of the appeals and ordered that the amount deposited with the Court be released to the appellant.
