Bombay High Court

HANUMANSINH GANGASINH THAKURversusTHE STATE OF MAHARASHTRA

Disposal
Withdrawn

Holding

The Court granted liberty to withdraw the bail applications and allowed re‑filing after the viscera report is filed or after six months, whichever is earlier.

Summary

The High Court of Bombay, Aurangabad bench, considered two bail applications filed by Hanumansinh Gangasinh Thakur and Darasingh Daulatsingh Thakur against the State of Maharashtra. Both applicants, through their counsel, sought liberty to withdraw the pending applications and to re‑file fresh bail applications once the prosecution’s viscera report became available, or after a specified period if the report was not filed. The Court granted liberty to withdraw the applications and stipulated that fresh applications could be filed after the viscera report is filed or after six months from the order, whichever is earlier. The Court directed that if a fresh application is filed after the viscera report, the trial court must consider the report; if filed without the report, the trial court may decide based on the merits provided the trial has not substantially progressed. Consequently, both bail applications were dismissed as withdrawn.

Issues considered

  • Whether the applicants may be permitted to withdraw their bail applications and re‑file them later.
  • Whether the availability of the viscera report should condition the re‑filing and consideration of fresh bail applications.

Subjects

  • bail
  • viscera report
