Holding

The bail application is disposed of as withdrawn.

Summary

Ankush Santosh Kurhade applied for bail before the Aurangabad Bench of the High Court of Bombay. The applicant's counsel indicated a lack of interest in obtaining bail, noting that the trial had already progressed with one witness examined, and requested the withdrawal of the bail application. The Court accepted the request and disposed of the bail application as withdrawn. The Court further directed that, given the charges under sections 307 and 109(3) of the Bhartiya Nyaya Sanhita, the trial court should endeavour to complete the trial within eight months of the order. The accused was instructed to cooperate with the trial and refrain from seeking unnecessary adjournments.

Issues considered

  • What is the appropriate disposition of a bail application when the applicant seeks its withdrawal?
