Leave to withdraw the bail application was granted, with liberty to file a fresh bail application before the trial court.

Summary

The applicant, Noorali Ajajali Saiyyad, filed a criminal bail application before the Bombay High Court. Subsequently, the applicant sought leave to withdraw that application and requested liberty to file a fresh bail application before the trial court on new grounds. The learned counsel for the applicant, Mr. Dilip Shinde, moved the court for such leave. The court, after considering the request, granted leave to withdraw the bail application and allowed the applicant to file a fresh application. The court clarified that the withdrawn application was not heard on its merits and that any fresh bail application would be decided on its own merits. Consequently, the bail application was disposed of as withdrawn.
