MANGALA MOHAN DHINDALEversusTHE STATE OF MAHARASHTRA AND ANOTHER

Disposal

Holding

The bail application was dismissed as withdrawn.

Summary

The petitioner, Mangala Mohan Dhindale, filed a regular bail application in a case involving offences under Sections 64 and 115 of the Bombay Nursing Service Act and Sections 4, 8 and 12 of the Protection of Children from Sexual Offences (POCSO) Act. After hearing counsel, the Court expressed reluctance to grant bail given the seriousness of the charges. The applicant’s counsel, on instruction, indicated that the bail application would not be pressed on its merits and instead sought a direction for the trial court to expedite the trial. The Court granted liberty to the applicant to seek such a direction. Consequently, the bail application was dismissed as withdrawn, with liberty granted to approach the trial court for a speedy conclusion of the trial.
