Bombay High Court
ASHRAF AHEMAD MIRZAversusTHE STATE OF MAHARASHTRA
- Disposal
- Withdrawn
Holding
The court granted leave to withdraw the bail application and directed that a fresh bail application may be filed after the charge-sheet is filed.
Summary
The applicant, Ashraf Ahemad Mirza, sought bail from the Bombay High Court, Aurangabad Bench, while the State of Maharashtra opposed the relief. Both parties presented arguments, and the State highlighted material against the applicant. The court, reluctant to grant bail at this stage, allowed the applicant to withdraw the current bail application and permitted filing a fresh application after the charge-sheet is filed. The bail application was therefore disposed of as withdrawn. The trial court will consider any fresh bail application on its merits in accordance with law.

- Whether bail should be granted to the applicant pending filing of the charge-sheet
- Whether the applicant may withdraw the bail application and file a fresh one later
