DILIP RAMESH PATAREversusTHE STATE OF MAHARASHTRA
- Disposal
- Withdrawn
Holding
The court did not grant bail and allowed the applicant to withdraw the application, permitting a fresh bail application after the charge-sheet is filed.
Summary
The petitioner, Dilip Ramesh Patare, filed a bail application before the High Court of Bombay, Aurangabad Bench, challenging his detention by the State of Maharashtra. Both parties presented arguments, with the State highlighting material against the petitioner. The Court expressed a disinclination to grant bail at that stage. Consequently, the petitioner’s counsel sought to withdraw the application, seeking liberty to file a fresh bail petition after the charge-sheet is filed. The Court granted the withdrawal and directed that any fresh bail application be considered by the trial court on its merits once the charge-sheet is filed.
