The applicant is entitled to bail in the present case.

Summary

The applicant, Aman Khan alias Adil Shah, was charged under Sections 316(2), 351(2) and 64 of the Bharatiya Nyaya Sanhita, 2023 for alleged non‑consensual sexual intercourse and related offences. The prosecution alleged that the applicant had repeatedly forced the victim into sexual acts, recorded obscene material, and extorted gold ornaments. The victim later filed an affidavit stating that the matter had been settled, that the relationship was consensual, and that she had no objection to the applicant’s release on bail. The court, after hearing counsel, considered the victim’s consent and the settlement, and ordered the applicant’s release on bail subject to a bond and conditions. The bail order also stipulated regular reporting to the police and compliance with trial procedures.
