Bombay High Court
PIRAJI @ CHANDRAKANT MARUTI SHINDEversusSTATE OF MAHARASHTRA
- Decided

Bail is granted to the applicant subject to the conditions specified in the order.
Summary
The Court considered an application under Section 439 of the Criminal Procedure Code (and Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023) for bail of accused No. 8 in FIR No. 11 of 2025, who was charged with offences under the Bharatiya Nyaya Sanhita, 2023 including forgery and false documents. The prosecution alleged that the applicant assisted in preparing false and forged documents to obtain surety in bail matters. The Court observed that four co‑accused had already been released on bail and that the applicant’s role was not materially different, noting his age of 60 years. On the basis of parity with the co‑accused, the Court found no ground to refuse bail and ordered his release on a personal bond of Rs 15,000 with several conditions. The order expressly limited its observations to bail and did not address the merits of the case.
Issues considered
- Whether bail should be granted to the accused under Section 439 CrPC given the nature of the offences and his alleged participation in forging documents.
- Whether the applicant’s age and the fact that co‑accused have already been released on bail affect the decision.
- What conditions, if any, should be imposed on the grant of bail.
