Bombay High Court

SIDDHESH KHANDU TANPUREversusSTATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

The Court granted bail to the applicant subject to a personal bond and conditions.

Summary

The applicant, Siddhesh Khandu Tanpure, was charged in Crime No.311 of 2024 for assault with intent to kill under IPC sections 307, 504 and 506 read with section 34. He had been in custody for one year and six months with no progress in the trial, while co‑accused with similar charges had been released on bail. The prosecution argued that the applicant might abscond or intimidate witnesses if released. The first informant, who was present in court, expressed no objection to granting bail. The Court, noting the prolonged detention, lack of trial progress, and the informant’s consent, ordered bail on a personal bond of Rs 25,000 with sureties, subject to conditions not to tamper with evidence or influence witnesses, and directed the trial court to continue the trial on its merits.

Issues considered

  • Whether the applicant is entitled to bail despite the seriousness of the offences under IPC sections 307, 504, 506 and 34
  • Whether the risk of absconding or tampering with witnesses warrants denial of bail
  • Whether the prolonged pre‑trial detention without trial progress justifies bail
