Holding

The court held that the applicant is not entitled to bail due to the seriousness of the murder charge and the strength of the prosecution's evidence.

Summary

The applicant, Lingraj alias Ningraj Suryakant Alure, was charged with murder, attempted murder, and offences of intimidation and criminal intimidation for killing his mother after a quarrel over money. An eye‑witness, the applicant's brother, testified that the applicant threatened and subsequently smashed his mother's head with a stone, leading to her death. Medical evidence corroborated the prosecution's case. The applicant sought bail, arguing that the circumstances did not warrant denial. The court examined the seriousness of the murder charge, the presence of an eye‑witness, and the supporting medical evidence, and concluded that the applicant did not merit the discretionary relief of bail. Consequently, the bail application was rejected.
