Bombay High Court

TUSHIRAM@TULSHI BABA BUDHA SONAWANEversusTHE STATE OF MAHARASHTRA

Decided
Disposal
Disposed Off

Holding

A bail application concerning the same criminal case that has already been dismissed cannot be entertained and must be dismissed.

Summary

The applicant, Tulshiram Sonawane, filed Bail Application No. 3157 of 2026 before the Bombay High Court, represented by Advocate Mr. Rupesh A. Jaiswal. The State, represented by Ms. Sukanta A. Karmakar, opposed the bail. The Court noted that an earlier bail application (No. 3140 of 2026) concerning the same accused and the same criminal case (C.R. No. 166 of 2023) had already been heard and dismissed. Both the present and the earlier applications were found to relate to the identical charge. Since the earlier application was dismissed, the Court held there was no ground to entertain a second bail request for the same case. Consequently, Bail Application No. 3157 of 2026 was dismissed.

Issues considered

  • Whether a second bail application can be entertained when a prior bail application concerning the same criminal case has already been dismissed.
