The Court granted bail to the applicant on the condition of a personal bond of Rs.25,000 and two solvent sureties, with directions not to tamper with evidence or influence witnesses.
Summary
The applicant, Rameshwar @ Monya Subhash More, was charged in Crime No.80 of 2024 for multiple offences including attempt to murder, assault with a dangerous weapon, and rioting, as well as violations under the Arms Act, Criminal Law Amendment Act, Maharashtra Police Act and the Maharashtra Control of Organised Crime Act. The prosecution alleged that on 23 February 2024 the applicant and co‑accused attacked the first informant and his friend with a sharp weapon intending to kill them. The applicant had been in custody for over one year and five months with no significant progress in the trial, and contended that the injuries were simple and that bail should be granted. The State highlighted two prior antecedents and warned that the applicant might abscond or intimidate witnesses if released. The Court, noting the prolonged pre‑trial detention, lack of trial progress, and that co‑accused with similar charges had already been bailed, ordered the applicant’s release on bail subject to a Rs.25,000 personal bond and two sureties, with conditions not to tamper with evidence or influence witnesses.
Issues considered
- Whether the applicant is entitled to regular bail despite the seriousness of the charges and prior antecedents
- Whether the length of pre‑trial detention and lack of trial progress justify granting bail
- Whether conditions such as surety and non‑interference with witnesses are sufficient to mitigate flight or witness‑tampering risks
