The court granted medical bail for four months with a Rs. 25,000 bond and standard conditions, finding the applicant's health condition sufficient grounds for bail.

Summary

The High Court considered two bail applications filed by Deepak Mohan Phad, a government clerk accused of multiple offences under the Bharatiya Nyaya Sanhita, 2023, including sections relating to assault, grievous hurt and forgery. Phad sought medical bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, citing post‑operative recovery after a hemorrhoidectomy and ongoing bleeding. The court examined a medical report from the prison's chief medical officer confirming his health issues and deemed them serious enough to warrant bail. It granted medical bail for a period of four months, conditioned on a cash bond of Rs. 25,000 with one or two sureties, monthly reporting to the investigating officer, and compliance with standard bail conditions. The order emphasized that the bail would not prejudice the trial and that any breach could lead to revocation.

Issues considered

  • Whether the accused is entitled to medical bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 given his post‑operative health condition
  • Whether the bond amount and conditions imposed are appropriate for the offences alleged
