Bail is granted to the applicant subject to the conditions specified by the court.

Summary

The applicant, Uttam Bajirao Jadhav, filed a bail application under Section 439 of the Code of Criminal Procedure, 1973 and Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with a criminal case (CR No. 348/2019) involving offences under IPC Sections 420, 465, 468 and 471 r/w 34. The applicant produced a settlement certificate from Union Bank of India showing that a non‑performing asset account had been fully repaid. The court directed the bank to appear and verify the certificate, which it did, confirming its authenticity. After considering the certificate and the applicant’s submissions, the court found that the applicant had made out a case for bail. Consequently, bail was granted on a personal bond of Rs. 25,000 with conditions including monthly reporting to the investigating officer, non‑interference with witnesses, and restriction on leaving Maharashtra. The bail application was allowed and disposed of on these terms.

Issues considered

  • Whether bail should be granted to the accused in a case involving serious economic offences under IPC Sections 420, 465, 468 and 471 r/w 34.
  • Whether the settlement certificate from the bank, indicating repayment of the NPA account, is a material factor for granting bail.
  • Whether the conditions imposed by the court are sufficient to safeguard the trial process.
