Bombay High Court
AJGAR FAKIR SHAIKHversusSTATE OF MAHARASHTRA AND ANR
- Decided

Holding
Bail is granted to the applicant subject to specified conditions.
Summary
The applicant, Ajgar Fakir Shaikh, sought bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for alleged offences under Sections 143(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3, 4 and 5 of the Immoral Traffic Act, 1956. He was arrested after being seen at Hotel Kranti Veer during a raid by the Social Cell Department. The complainant (Respondent No.2) expressed no objection to bail, stating the applicant was present voluntarily without coercion. The court observed that the applicant's complicity, if any, must be proved at trial and that the prima facie facts supported granting bail. Accordingly, the court granted bail subject to a cash bond of Rs.25,000, reporting requirements, residence restrictions, and prohibitions on tampering with evidence, while expressly reserving the right to cancel bail for any breach.
Issues considered
- What is the appropriateness of granting bail under Section 483 BNSS for offences under BNS and the Immoral Traffic Act?
- Does the complainant's lack of objection and the prima facie facts justify bail?
- What conditions are appropriate to impose on bail in this context?
